Welcome to Signiqo ("Signiqo," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Signiqo website, services, software, and applications (collectively, the "Service"). Please read these Terms carefully before using our Service.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to all of these Terms, do not access or use the Service.
1. Description of Service
Signiqo provides a decentralized identity and authentication solution enabling users to interact with Web3 applications using biometric data transformed into cryptographic keys, Decentralized Identifiers (DIDs), and other related technologies. Our Service aims to simplify Web3 access while enhancing security and user control.
2. Eligibility
You must be at least 18 years old or the age of legal majority in your jurisdiction to use our Service. By using the Service, you represent and warrant that you meet these eligibility requirements.
3. User Accounts and Responsibilities
3.1. Account Creation: To use certain features of the Service, you may need to create an account or associate a DID. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
3.2. Security: Signiqo is designed as a non-custodial service. This means you are solely responsible for the security of your device(s), biometric data access, PINs, any recovery mechanisms you set up, and any cryptographic keys or DIDs generated or managed through the Service. Signiqo does not store your raw biometric data or private keys in a way that we can access them. You are responsible for all activities that occur under your account or associated DID, whether or not you know about them.
3.3. Biometric Data: You acknowledge that the Service relies on your device's native biometric authentication capabilities (e.g., Face ID, fingerprint sensor) and/or Secure Enclave or Trusted Execution Environment. The security and privacy of your biometric data processed on your device are subject to your device's security features and your own security practices.
4. Use of the Service
4.1. Permitted Use: You agree to use the Service only for lawful purposes and in accordance with these Terms and any applicable laws and regulations of Mexico and your local jurisdiction.
4.2. Prohibited Conduct: You agree not to:
- Use the Service for any illegal or unauthorized purpose.
- Interfere with, disrupt, or create an undue burden on the Service or the networks or services connected to the Service.
- Attempt to gain unauthorized access to any part of the Service, other accounts, computer systems, or networks connected to the Service.
- Circumvent, disable, or otherwise interfere with security-related features of the Service.
- Use any Gammabot, spider, or other automatic device, process, or means to access the Service for any purpose, including monitoring or copying any of the material on the Service, without our prior written consent.
- Introduce any viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
- Impersonate or attempt to impersonate Signiqo, a Signiqo employee, another user, or any other person or entity.
- Engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which, as determined by us, may harm Signiqo or users of the Service or expose them to liability.
5. Intellectual Property Rights
The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Signiqo, its licensors, or other providers of such material and are protected by Mexican and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
These Terms permit you to use the Service for your personal, non-commercial use only, or for legitimate business purposes if you are integrating Signiqo as a developer in accordance with any developer agreements. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service, except as generally and ordinarily permitted through the Service according to the Gammabed use.
6. Third-Party Services and Content
The Service may integrate with or provide links to third-party websites, applications, or services ("Third-Party Services"). Signiqo does not control and is not responsible for Third-Party Services. You acknowledge and agree that Signiqo is not responsible or liable for any damage or loss caused or alleged to be caused by or in connection with your use of or reliance on any Third-Party Services. Your use of Third-Party Services is subject to their respective terms and privacy policies.
7. Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SIGNIQO MAKES NO WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
YOU ACKNOWLEDGE THAT WEB3 TECHNOLOGIES, INCLUDING BLOCKCHAINS, CRYPTOGRAPHIC KEYS, AND DECENTRALIZED IDENTIFIERS, ARE NOVEL AND EXPERIMENTAL. YOU ARE SOLELY RESPONSIBLE FOR UNDERSTANDING THE RISKS ASSOCIATED WITH THESE TECHNOLOGIES AND THE USE OF THE SERVICE. SIGNIQO IS NOT RESPONSIBLE FOR ANY LOSSES INCURRED AS A RESULT OF YOUR USE OF SUCH TECHNOLOGIES OR THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF ACCESS TO YOUR DIGITAL ASSETS OR IDENTITY DUE TO LOST OR COMPROMISED CREDENTIALS OR DEVICE SECURITY FAILURES.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW (INCLUDING THE MEXICAN FEDERAL CONSUMER PROTECTION LAW - LEY FEDERAL DE PROTECCIÓN AL CONSUMIDOR), IN NO EVENT WILL SIGNIQO, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SERVICE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.
9. Indemnification
You agree to defend, indemnify, and hold harmless Signiqo, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.
10. Termination
We may terminate or suspend your access to all or part of the Service at any time, with or without notice, for any reason, including, without limitation, if we believe you have violated these Terms. Upon termination, your right to use the Service will immediately cease.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
11. Governing Law and Jurisdiction
These Terms and any dispute or claim arising out of, or related to them, their subject matter, or their formation (in each case, including non-contractual disputes or claims) shall be governed by and construed in accordance with the federal laws of the United Mexican States ("Mexico").
Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Service shall be instituted exclusively in the competent federal courts located in Mexico City, Mexico, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
12. Changes to the Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, in whole or in part, please stop using the Service.

14. Miscellaneous
14.1. Entire Agreement: These Terms constitute the entire agreement between you and Signiqo regarding the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Service.
14.2. Severability: If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
14.3. Waiver: No waiver by Signiqo of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Signiqo to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
